04 · 2026 Appraisal Rules

Market Value, Homestead Cap & the 2026 Non-Homestead Circuit Breaker

Texas distinguishes market value from an appraisal limitation. A cap or circuit breaker can reduce the amount of appraised value used for taxation without changing the property’s market-value estimate.

Market Value

The appraisal district estimates property at market value as of January 1 under Texas property-tax law.

Homestead Appraisal Cap

A qualifying residence homestead generally cannot increase in appraised value by more than 10% per year, plus the value of qualifying new improvements.

2026 Circuit Breaker

Qualifying non-homestead real property with a prior-year appraised value of $5.32 million or less can be subject to the temporary 20% appraisal limitation.

The 10% homestead cap does not mean your tax bill can rise by only 10%. Exemptions, tax rates, voter-approved obligations, new improvements and taxing-unit changes can affect the final amount.
2026 circuit-breaker sunset: the Texas Comptroller states that the temporary non-homestead circuit-breaker limitation expires December 31, 2026 unless state law changes.

New improvements are generally added outside the applicable appraisal limitation. For a newly constructed Montgomery County home, check whether MCAD correctly reflects the January 1 completion status, building area, garages, pools and other improvements.

Texas voters approved higher statewide school-district residence-homestead exemptions effective for the current system. For 2026, the mandatory general school-district homestead exemption is $140,000.

Texas agricultural treatment is a special appraisal based on qualifying land use. It is different from a Florida-style exemption and should not be described simply as an “ag exemption.”

Qualifying land is generally appraised according to productivity rather than ordinary market value when statutory use-history and intensity requirements are met.

Wildlife Management

Land already qualifying for appropriate agricultural appraisal may continue through wildlife-management use when the statutory requirements are satisfied.

Timber

Qualifying timberland can receive special appraisal under separate Texas Tax Code provisions and documentation requirements.

2026 Montgomery CAD Renditions & $125,000 Business Personal Property Exemption

Texas businesses may have to render taxable business personal property such as machinery, equipment, furniture, fixtures, inventory and other income-producing tangible property.

For most property types, renditions are due April 15. A timely written request generally extends the deadline to May 15, and an additional 15 days can be available for good cause.

Following the 2025 constitutional amendment, Texas provides an exemption for qualifying income-producing tangible personal property with taxable value of $125,000 or less in a taxing unit, subject to the governing law.

Do not assume the exemption eliminates every reporting duty. Businesses should verify their filing obligation and current MCAD instructions before skipping a rendition.

How to Protest a 2026 Montgomery CAD Appraisal

If you disagree with MCAD’s appraised value, exemption decision, property characteristics or another appealable determination, Texas law provides a protest process before the Appraisal Review Board.

Usual deadline: most protests must be filed by May 15 or 30 days after MCAD mailed the Notice of Appraised Value, whichever is later. Use the deadline printed on your actual notice rather than assuming May 15 applies to every account.
